These Terms of Service govern your use of The Grand Moment platform operated by TRD Media Group LLC at thegrandmoment.events. By creating an account or using our services, you agree to these Terms. The Grand Moment is a technology platform connecting clients planning events with vendors who provide event services; we are not a party to any agreement between clients and vendors.
Platform Description
The Grand Moment is a marketplace that connects clients planning events with vendors who provide event services. We provide tools for vendor discovery, AI-powered event visualization, quoting, contracts, invoicing, payments, and event management. We are a technology platform — we are not a party to any agreement between clients and vendors, and we do not warrant any specific outcome of the relationship between Customer and Vendor.
Account Registration
- 2.1. You must provide accurate and complete information when creating an account, and keep that information current.
- 2.2. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
- 2.3. You must be at least 18 years old to create an account.
- 2.4. One person or entity may not maintain multiple accounts without our prior written approval.
Vendor Responsibilities
If you register as a vendor on The Grand Moment, you agree to:
- 3.1. Provide accurate information about your business, services, pricing, and availability.
- 3.2. Maintain professional conduct in all interactions with clients and other vendors on the platform.
- 3.3. Fulfill commitments made through quotes, contracts, and agreements facilitated on the platform.
- 3.4. Maintain your own contracts, insurance, licenses, and permits as required by applicable law in every jurisdiction in which you operate.
- 3.5. Respond to client inquiries in a timely manner.
Client Responsibilities
If you use The Grand Moment as a client, you agree to:
- 4.1. Provide accurate event information, including dates, guest counts, and venue details.
- 4.2. Communicate in a timely manner with vendors regarding event planning and logistics.
- 4.3. Honor payment terms outlined in quotes and contracts accepted through the platform.
- 4.4. Treat vendors with respect and professionalism.
Content Ownership & License
In shortYou keep ownership of everything you upload. We get a license — including for social media, editorial features, and AI rendering — to operate and promote the Service, with attribution to your studio.
5.1You own your content.
Vendors retain all rights, title, and interest in the photos, descriptions, portfolio items, video, profile information, pricing, reviews, and other content ("Vendor Content") uploaded to the platform. Nothing in these Terms transfers ownership of Vendor Content to The Grand Moment.
5.2License to The Grand Moment.
By uploading Vendor Content, you grant The Grand Moment a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to copy, store, host, display, distribute, adapt, perform, and otherwise use your Vendor Content for the purpose of operating, promoting, and improving the Service. This license permits The Grand Moment to use Vendor Content in marketing, editorial features, social media (including Instagram, Pinterest, and similar platforms), real-wedding features, vendor-of-the-month features, and AI-driven features such as vision rendering, matching, and recommendations, in each case with attribution to your studio. The license extends to The Grand Moment's affiliates, successors, and bona fide service providers acting on its behalf, and lasts for the duration of your account plus a 12-month archival tail after termination for legal records, dispute resolution, and operational continuity.
5.3Your warranties on Vendor Content.
You warrant that you own or have all necessary rights to upload your Vendor Content (including, where applicable, photographer permission to use third-party-captured images for marketing); that no Vendor Content infringes any third party's intellectual property, contract, privacy, publicity, or other rights; that all Vendor Content is accurate and not misleading; and that all photographs depict real work you performed (no stock photos misrepresented as your own). You will indemnify The Grand Moment against any third-party claim arising from a breach of these warranties.
5.4Platform content.
The Grand Moment brand, designs, software, and features are owned by TRD Media Group LLC. You may not copy, reproduce, or redistribute platform content without our prior written permission.
5.5Removal.
You may remove your content from the platform at any time through your account settings. We will remove it from active display within a reasonable timeframe, subject to the 12-month archival tail described in 5.2 for legal records and dispute resolution.
AI-Generated Content
In shortVision renders are creative previews, not guarantees. Actual events depend on vendor execution and venue conditions.
The Grand Moment offers AI-powered event vision mockups and design previews. These are creative previews meant to inspire and communicate ideas — they are not guarantees of the final result. Actual event outcomes depend on vendor execution, venue conditions, and other real-world factors. Neither The Grand Moment nor the AI service providers are liable for differences between generated previews and actual events.
Payments
- 7.1. All payments are processed securely through Stripe. By making a payment, you also agree to Stripe's Terms of Service.
- 7.2. Payment terms (deposits, balances, due dates) are set by individual vendors through their quotes and contracts.
- 7.3. The Grand Moment may charge platform fees for certain services. These will be clearly disclosed before you are charged.
- 7.4. Refund policies are determined by individual vendors. Disputes between clients and vendors regarding payments should be resolved directly between the parties.
Prohibited Conduct
You agree not to:
- 8.1. Use the platform for any illegal or unauthorized purpose.
- 8.2. Submit false, misleading, or fraudulent information.
- 8.3. Harass, threaten, or abuse other users of the platform.
- 8.4. Attempt to circumvent platform fees by taking transactions off-platform after making initial contact through The Grand Moment.
- 8.5. Scrape, crawl, or use automated tools to extract data from the platform.
- 8.6. Upload content that infringes on intellectual property rights or contains malware.
Limitation of Liability
In shortWe're a marketplace, not a party to your contracts. Our liability is capped at fees you paid us in the prior 12 months.
The Grand Moment is a marketplace platform. We facilitate connections between clients and vendors but are not a party to any agreement between clients and vendors. We do not guarantee the quality, safety, or legality of vendor services. To the maximum extent permitted by law:
- 9.1. We are not liable for any damages arising from vendor-client interactions, event outcomes, or service delivery.
- 9.2. Our total liability for any claim related to the platform is limited to the amount you paid us in the 12 months preceding the claim.
- 9.3. We are not liable for indirect, incidental, consequential, or punitive damages.
Termination
- 10.1. You may close your account at any time by contacting us or using account settings.
- 10.2. We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.
- 10.3. Upon termination, your right to use the platform ceases. Data deletion follows our Privacy Policy.
Dispute Resolution
11.1Informal resolution.
Before filing any formal complaint, you agree to contact us at hello@thegrandmoment.events and attempt to resolve the dispute informally for at least 30 days.
11.2Binding arbitration.
If informal resolution fails, disputes will be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association.
11.3Class action waiver.
You agree to resolve disputes on an individual basis and waive any right to participate in a class action.
Governing Law
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law principles.
Modifications
The Grand Moment may modify these Terms at any time by posting the updated Terms at thegrandmoment.events/terms, updating the version number and effective date, and providing notice through the Service or by email at least 30 days in advance of material changes (with shorter notice permitted for changes required by law or to address security or compliance issues). Continued use of the Service after the effective date of a modified Terms constitutes acceptance of those modified Terms. If you do not agree, you must close your account before the effective date.
