Terms of Service | The Grand Moment

These Terms of Service ("Terms") govern your use of The Grand Moment platform operated by TRD Media Group LLC ("we," "us," or "our") at thegrandmoment.events. By creating an account or using our services, you agree to these Terms.

1. Platform Description

The Grand Moment is a marketplace that connects clients planning events with vendors who provide event services. We provide tools for vendor discovery, AI-powered event visualization, quoting, contracts, invoicing, payments, and event management. We are a technology platform — we are not a party to any agreement between clients and vendors.

2. Account Registration

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the security of your account credentials.
You must be at least 18 years old to create an account.
One person or entity may not maintain multiple accounts without our prior written approval.

3. Vendor Responsibilities

If you register as a vendor on The Grand Moment, you agree to:

Provide accurate information about your business, services, pricing, and availability.
Maintain professional conduct in all interactions with clients and other vendors on the platform.
Fulfill commitments made through quotes, contracts, and agreements facilitated on the platform.
Maintain your own contracts, insurance, licenses, and permits as required by applicable law.
Respond to client inquiries in a timely manner.

4. Client Responsibilities

If you use The Grand Moment as a client, you agree to:

Provide accurate event information, including dates, guest counts, and venue details.
Communicate in a timely manner with vendors regarding event planning and logistics.
Honor payment terms outlined in quotes and contracts accepted through the platform.
Treat vendors with respect and professionalism.

5. Content Ownership and License

Your content: Vendors retain ownership of all photos, descriptions, portfolio items, and other content they upload to the platform. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to display, promote, and distribute that content within the platform and in marketing materials for The Grand Moment.
Platform content: The Grand Moment brand, designs, and features are owned by TRD Media Group LLC. You may not copy, reproduce, or redistribute platform content without our permission.
Removal: You may remove your content from the platform at any time through your account settings. We will remove it from active display within a reasonable timeframe.

6. AI-Generated Content

The Grand Moment offers AI-powered event vision mockups and design previews. These are creative previews meant to inspire and communicate ideas — they are not guarantees of the final result. Actual event outcomes depend on vendor execution, venue conditions, and other real-world factors. Neither The Grand Moment nor the AI service providers are liable for differences between generated previews and actual events.

7. Payments

All payments are processed securely through Stripe. By making a payment, you also agree to Stripe's Terms of Service.
Payment terms (deposits, balances, due dates) are set by individual vendors through their quotes and contracts.
The Grand Moment may charge platform fees for certain services. These will be clearly disclosed before you are charged.
Refund policies are determined by individual vendors. Disputes between clients and vendors regarding payments should be resolved directly between the parties.

8. Prohibited Conduct

You agree not to:

Use the platform for any illegal or unauthorized purpose.
Submit false, misleading, or fraudulent information.
Harass, threaten, or abuse other users of the platform.
Attempt to circumvent platform fees by taking transactions off-platform after making initial contact through The Grand Moment.
Scrape, crawl, or use automated tools to extract data from the platform.
Upload content that infringes on intellectual property rights or contains malware.

9. Limitation of Liability

The Grand Moment is a marketplace platform. We facilitate connections between clients and vendors but are not a party to any agreement between clients and vendors. We do not guarantee the quality, safety, or legality of vendor services. To the maximum extent permitted by law:

We are not liable for any damages arising from vendor-client interactions, event outcomes, or service delivery.
Our total liability for any claim related to the platform is limited to the amount you paid us in the 12 months preceding the claim.
We are not liable for indirect, incidental, consequential, or punitive damages.

10. Termination

You may close your account at any time by contacting us or using account settings.
We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.
Upon termination, your right to use the platform ceases. Data deletion follows our Privacy Policy.

11. Dispute Resolution

Informal resolution: Before filing any formal complaint, you agree to contact us at privacy@thegrandmoment.events and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration: If informal resolution fails, disputes will be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association.
Class action waiver: You agree to resolve disputes on an individual basis and waive any right to participate in a class action.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law principles.

13. Modifications

We may update these Terms from time to time. When we make significant changes, we will notify registered users by email and update the "Last updated" date at the top of this page. Your continued use of the platform after changes take effect means you accept the updated Terms. If you do not agree with the changes, you should stop using the platform and close your account.
